1. In accordance with the state to state Loan Agreement between Ministry of Finance of P.R. China and KfW for Hengshui Lake Conservation and Management Project. CMC International Tendering Co., Ltd. (Hereinafter referred to as “Tendering Agent ”) entrusted by Hebei Hengshui Lake National Nature Reserve Management Committee (Herein after referred to as “Employer”) now invites sealed Bids from eligible Bidders for the construction of the project. The Employer intends to apply all the proceeds of this loan to eligible payments under the Construction Contract for which this Bidding document is issued.
根據(jù)中國財(cái)政部與KfW為衡水湖濕地保護(hù)與管理項(xiàng)目簽訂的國家間貸款協(xié)議,中機(jī)國際招標(biāo) 受河北衡水湖國家級(jí)自然保護(hù)區(qū)管理委員會(huì) 的委托，現(xiàn)在邀請(qǐng)有資格提供項(xiàng)目施工的投標(biāo)人參與投標(biāo)。發(fā)包人擬利用貸款支付本招標(biāo)文件下的施工合同的付款。
2. We hereby invite: Any legal person or organization registered and operated from within the People’s Republic of China and all countries which have regular trade relations with PRC to participate in the Bid. Construction financed under Sino-German Financial Cooperation Credit Loan shall be tendered and contracted as one contract with a successful Contractor. Any local or third countries goods and services shall be included in this tendering whether in this Contract or in Supplies or Sub-contracts, with the successful Contractor being responsible towards the Tendering Agent.
我們邀請(qǐng)：在中國境內(nèi)注冊(cè)和運(yùn)營和所有與中華人民共和國有正常貿(mào)易往來的法人或其他組織參與投標(biāo)。中德財(cái)政合作貸款下施工的提供將組成一個(gè)招標(biāo)包并且與成功的合同方簽署一個(gè)合同。任何當(dāng)?shù)鼗虻谌絿业氖┕ざ紝诒景?，無論本合同或供貨合同或分包合同，由成功的合同方直接向招標(biāo)機(jī)構(gòu)負(fù)責(zé)。
3. A consortium as the Bidder is not accepted.
本項(xiàng)目不接受聯(lián)合體投標(biāo)。
4. The Bid will be conducted through the International Competitive Bid.
本次招標(biāo)為國際競爭性招標(biāo)。
5. The Bidder shall qualify with the following requirements:
投標(biāo)人必須滿足：
(1) The Bidder is legal person or other organization that has purchased the bidding documents from the Tenderee or the Tendering Agent, and participated in the bid. Any legal person or organization that has not purchased the bidding documents from the Tenderee or the Tendering Agent is not allowed to participate in the bid.
投標(biāo)人是響應(yīng)招標(biāo)、已在招標(biāo)人或招標(biāo)機(jī)構(gòu)處領(lǐng)購招標(biāo)文件并參加投標(biāo)競爭的法人或其他組織。任何未在招標(biāo)人或招標(biāo)機(jī)構(gòu)處領(lǐng)購招標(biāo)文件的法人或其他組織均不得參加投標(biāo)。
(2) Any legal person or other organization that has conflict of interest with the Employer and may have impact on fairness of the bidding is not allowed to participate in the bid.
與招標(biāo)人存在利害關(guān)系可能影響招標(biāo)公正性的法人或其他組織不得參加投標(biāo)。
(3) Any legal person or other organization that has been entrusted to provide consulting service at the preliminary stage of the project or to prepare the bidding document is not allowed to participate in the bid, nor to prepare bid documents or provide consulting service to the Bidder.
接受委托參與項(xiàng)目前期咨詢和招標(biāo)文件編制的法人或其他組織不得參加受托項(xiàng)目的投標(biāo)，也不得為該項(xiàng)目的投標(biāo)人編制投標(biāo)文件或者提供咨詢。
(4) Different bidders that have the same person in charge or have the relationship of share-holding or management should not participate in the bids for the same package, except for the case to form a joint venture to bid.
單位負(fù)責(zé)人為同一人或者存在控股、管理關(guān)系的不同單位，不得參加同一招標(biāo)項(xiàng)目投標(biāo)，
共同組成聯(lián)合體投標(biāo)的除外。
(5) The Bidder may participate in the bids only if they are legally and financially autonomous, if they operate under relevant law, and if they are not a dependent agency of the Employer or the Tender Agent.
只有在法律上和財(cái)務(wù)上獨(dú)立、合法運(yùn)作并獨(dú)立于發(fā)包人和招標(biāo)機(jī)構(gòu)的投標(biāo)人才能參加投標(biāo)。
(6) The Bidder shall successfully complete registration on ,. Otherwise, the bidders can’t enter into bidding procedures, and any consequence arisen thereafter shall be borne by bidders.
投標(biāo)人應(yīng)在中國通用招標(biāo)網(wǎng)上成功注冊(cè)，否則，投標(biāo)人將不能進(jìn)入招標(biāo)程序，由此產(chǎn)生的任何后果均由投標(biāo)人承擔(dān)。
(7) Within three years before the tender, the bidder has no major illegal record in the business activities.
參加本項(xiàng)目投標(biāo)前三年內(nèi)，投標(biāo)人在經(jīng)營活動(dòng)中沒有重大違法記錄。
(8) Two or more than two legal persons do not participate in the bid at the same time when they have same legal representative.
投標(biāo)人法定代表人為同一個(gè)人的兩個(gè)及兩個(gè)以上法人不得同時(shí)參加投標(biāo)。
(9) The bidder shall have a sound quality assurance system and pass Environmental, Social, Health and Safety (ESHS) Qualification.
投標(biāo)人須具有完善的質(zhì)量保證體系，并通過環(huán)境、社會(huì)、健康和安全資格認(rèn)證。
(10) The bidder has the corresponding financial capability of the project. The registered capital of RMB 10 million or above shall be required from domestic bidders and that an equity of EUR 1 million or above shall be required from foreign bidders.
投標(biāo)人有執(zhí)行本項(xiàng)目相應(yīng)的財(cái)務(wù)能力。境內(nèi)投標(biāo)人的注冊(cè)資金為1000萬元人民幣及以上，境外投資人的股權(quán)為100萬歐元及以上。
All pending litigation and arbitration, if any, shall be treated as resolved against the Bidder and so shall in total not represent more than fifty percent (50%) of the Bidder’s net worth calculated as the difference between total assets and total liabilities.
所有針對(duì)投標(biāo)人的未決訴訟和仲裁都將被認(rèn)為是已經(jīng)解決的、且不能超過投標(biāo)人資產(chǎn)凈值的50%。投標(biāo)人的凈資產(chǎn)(投標(biāo)人總資產(chǎn)和總負(fù)債的差)應(yīng)為正值。
(12) Minimum average annual construction turnover of EUR 1.5 million or the equivalent of EUR 1.5 million, calculated as total certified payments received for contracts in progress or completed, within the last three (3) years(2016/2017/2018). The source of exchange rate shall be the Selling Exchange rate issued by the Bank of China on the time of publishing Bid.
根據(jù)過去3年里(2016/2017/2018年)，已完成或正在實(shí)施的合同已收到的付款額計(jì)算的最低年均營業(yè)額應(yīng)達(dá)到150萬歐元，或相當(dāng)于150萬歐元。匯率按公告發(fā)布日中國銀行發(fā)布的賣出價(jià)折算。
(13) Bank references is issued within 3 months before deadline of bid submission by a reputable first class bank.
投標(biāo)截止日期前3個(gè)月由一級(jí)銀行出具的銀行資信證明。
(14) The Bidder must demonstrate that it has access to or availability of financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, other than contractual advance payments to meet the following cash flow requirement is at least: EUR 1.5 million equivalents.
投標(biāo)人必須證明有權(quán)使用或可用性的財(cái)務(wù)資源，如流動(dòng)資產(chǎn)，沒有負(fù)債的真實(shí)資產(chǎn)，信用額度和其他金融手段，除了合同的預(yù)付款，現(xiàn)金流至少是150萬歐元的等價(jià)物。
(15) A. Bidders in China shall have the second class and above qualifications of general contracting for water conservancy and hydropower projects, and bidders outside China must have the same qualifications.
中國境內(nèi)投標(biāo)人須具有水利水電工程施工總承包二級(jí)及以上資質(zhì)，中國境外投標(biāo)人具有同等的資質(zhì)。
B. In the past five years starting 1st January,2014, at least two similar projects have been completed in the construction
過去5年里 ，至少完成2個(gè)類似項(xiàng)目合同的建設(shè)。
C. The person in charge of the project shall be the official registration of the bidder. The person of Bidders within China shall have Grade II registered construction engineer for the water conservancy and hydropower engineering level or above, the person of Bidder outside China has equivalent qualification, and have similar experience.
項(xiàng)目負(fù)責(zé)人須為投標(biāo)人本單位正式注冊(cè)人員，中國境內(nèi)投標(biāo)人的項(xiàng)目負(fù)責(zé)人應(yīng)具有水利水電工程專業(yè)二級(jí)注冊(cè)建造師執(zhí)業(yè)資格及以上，中國境外投標(biāo)人的項(xiàng)目負(fù)責(zé)人應(yīng)具有同等的資質(zhì)，并有類似工程經(jīng)驗(yàn)。
Members need to have aqualification with engineers or above titles or equivalent, the above staff are the official registration of the company.
項(xiàng)目組其他組成人員具有工程師或以上職稱或相當(dāng)于，為本單位正式注冊(cè)人員。
